Please read these Terms of Service (“Terms”) carefully before using the muscleconcierge.com website (the “Site”) and the services offered by Muscleconcierge (“we,” “us,” or “our”).

1. Agreement to Terms

By accessing our Site, booking an appointment, or using our services, you (“User,” “you,” “your”) agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you must not access the Site or use our services.

2. Services and Bookings

2.1. Appointment Booking: Our Site provides a booking service, powered by wpAmelia, to allow you to schedule appointments for our Electrical Muscle Stimulation (EMS) services.

2.2. Accurate Information: To book an appointment, you must provide current, complete, and accurate information, including your full name, email address, phone number, and physical address. You are responsible for keeping this information up-to-date.

2.3. Fees, Payment, and Booking Deposit: You agree to pay all charges for services you book. To secure your appointment, we require a $150 Booking Deposit at the time of booking. This deposit is not an extra fee; it will be applied toward the total cost of your scheduled service. The remaining balance is due at the time of your appointment.

2.4. Cancellation and Rescheduling Policy / Booking & Cancellation Policy: A $150 deposit is required to secure your appointment and will be applied to your total service cost.We kindly request at least 24 hours’ notice for any cancellations or changes. Cancellations made with less than 24 hours’ notice will forfeit the deposit.

[IMPORTANT: We require at least 24 hours notice for any cancellation or rescheduling. Appointments cancelled or rescheduled with less than 24 hours notice will be subject to a cancellation fee of 150$. No-shows will be charged the full price of the scheduled service.]

We recognize that uncontrollable circumstances can arise. In the event of a genuine emergency, please contact us as soon as you are able. We will make every reasonable effort to accommodate your need to reschedule.

3. CRITICAL: Medical Disclaimer & User Responsibility

3.1. No Medical Advice: All content on this Site, including blog posts, descriptions, and FAQs, is provided for informational purposes only. It is not intended as, and shall not be understood or construed as, professional medical advice, diagnosis, or treatment.

3.2. Consult Your Physician: Electrical Muscle Stimulation (EMS) is not suitable for everyone. You agree to consult with your physician or other qualified healthcare provider before beginning any EMS service with us. You must inform us of any pre-existing medical conditions, and you agree to assume all risks associated with using our services.

3.3. Contraindications: You must not use EMS services if you have a pacemaker, implanted electronic device, heart condition, epilepsy, or are pregnant. You are responsible for informing us of any and all medical conditions.

3.4. Assumption of Risk: Your use of our EMS services is at your sole risk. You voluntarily accept and assume all risks of injury, illness, damage, or loss that may result from using our services.

4. Intellectual Property

All content on this Site, including text, graphics, logos, images, and blog posts, is the exclusive property of Muscleconcierge and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our express written permission.

5. User Conduct & Prohibited Uses

You agree not to use the Site for any unlawful purpose or in any way that could harm, disable, or impair the Site. You are prohibited from:

  • Attempting to gain unauthorized access to our systems or the wpAmelia booking service.
  • Using the Site to transmit any spam, viruses, or other harmful code.
  • Scraping, “data-mining,” or otherwise attempting to extract data from the Site.

6. Limitation of Liability

To the fullest extent permitted by law, Muscleconcierge (including its owners, employees, and affiliates) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any personal injury, illness, or property damage arising from:

  • (a) Your access to, use of, or inability to access or use our Site or services;
  • (b) Any content or information obtained from the Site, including any reliance placed on such information;
  • (c) Your use of our EMS services.

This Site and our services are provided “AS IS” and “AS AVAILABLE” without any warranties of any kind, whether express or implied, including the warranty of merchantability or fitness for a particular purpose.

7. Indemnification

You agree to defend, indemnify, and hold harmless Muscleconcierge from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:

  • (a) Your use of and access to the Site and services;
  • (b) Your violation of any of these Terms;
  • (c) Your violation of any third-party right, including any intellectual property or privacy right;
  • (d) Any personal injury, illness, or harm resulting from your use of our services.

8. Third-Party Links

Our Site may contain links to third-party websites or services that are not owned or controlled by Muscleconcierge. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Illinois and the United States, without regard to its conflict of law provisions.

10. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the “Effective Date” at the top.
